This Agreement is between you and Bengaluru NavaNirmana Party (“we,” “us,” or “our”), and governs your access to and use of the media, software, programs, website, tools, features, databases, materials, content, platforms, forums, portals, or information available on or through the website https://nammabnp.org (“Website”) and any other website offered by us.

You may enter into this Agreement on behalf of yourself or on behalf of a legal entity. If you enter into this Agreement on behalf of a legal entity, you represent that you are a duly authorized representative with the authority to bind that legal entity to this Agreement. All references to “you” and “your” in this Agreement mean the person accepting this Agreement as an individual or the legal entity for which the representative is acting.

GENERAL

By accessing or using the Website you agree to be bound by these Terms. If you disagree with any part of the Terms, do not access the Website. We reserve the right, at our sole discretion, to amend, change, modify, revise or replace these Terms at any time by posting revised Terms on the Service.

You must be a human to access or use the Website. You must be able and competent to enter into this Agreement and undertake legally binding obligations under Indian law. You must be 18 years or older. If it comes to our attention that you are under the legal age or are otherwise ineligible to enter into this Agreement or to use the Website, your access may be terminated without warning.

If you wish to Join Team BNP, Get a Membership with BNP, Donate to BNP, Sign a BNP Petition, Pledge to support a BNP cause/event, Contact BNP or otherwise engage with BNP through the Website, you may be required to provide and verify personal information. 
we have reasonable grounds to suspect is untrue, inaccurate, out of date or incomplete, we may, in our sole discretion, discontinue the provision of the Website to you.

By continuing to access or use the Website after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the revised terms, you are no longer authorized to access or use the Website. You are responsible for reviewing these Terms for any changes, so please check back here every time you access or use the Website.

LIMITED USE

  • impersonates another person
  • threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting other nation
  • is in the nature of an online game that is not verified as a permissible online game
  • is in the nature of advertisement or surrogate advertisement or promotion of an online game that is not a permissible online game, or of any online gaming intermediary offering such an online game or
  • violates any law for the time being in force.

In the event you breach these Terms, we have the right to terminate your access or usage rights to the Website immediately, or remove non-compliant information or both, in our sole discretion. In addition to our rights in these Terms, we may take any legal action and implement any technical remedies to prevent the violation of this provision and to enforce these Terms.

COMMUNICATIONS

By accessing or using the Website, you consent to receiving calls, messages, instant messages, e-mails, and communications from us and others authorised by us. We may send notifications to you via email or via SMS or via third party website such as WhatsApp, including to verify your identity, your phone number, and your email id. You may also be contacted by service providers with whom we have entered into a contract in furtherance of our rights, duties and obligations under this Agreement and all other policies followed by us. The sharing of the information provided by you is governed by our Privacy Policy.

USER GENERATED CONTENT

You are solely responsible for the content of, and for any harm resulting from, any User Generated Content that you post, upload, link to or otherwise make available via the Website, regardless of the form of that Content. We are not responsible for any public display or misuse of your User Generated Content.

In connection with your User Generated Content, you affirm, represent and warrant the following:

(a) you have the written consent of each and every identifiable natural person in the User Generated Content, if any, to use such person’s name or likeness in the manner contemplated by the Website and these Terms, and each such person has released you from any liability that may arise in relation to such use;

(b) you have obtained and are solely responsible for obtaining all consents as may be required by law to post any User Generated Content relating to third parties; and 

(c) your User Generated Content and our use thereof as contemplated by these Terms and the Website will not violate any law or infringe any rights of any third party, including but not limited to Intellectual Property Rights and privacy rights.

To the best of your knowledge, all your User Generated Content and other information that you provide to us is truthful and accurate.

We have the right, in our sole and absolute discretion, (a) to edit, redact, or otherwise change any User Generated Content; (b) to re-categorize any User Generated Content to place them in more appropriate locations on the Website; and (c) to screen or delete any User Generated Content at any time and for any reason, without notice.

We will access, process or use User Generated Content for the following reasons (the “Permitted Uses”): 

(i) consistent with this Agreement and as required to perform our obligations and provide the Website; 

(ii) in accordance with our Privacy Policy;

(iii) as authorized or instructed by you, including when you request to Join BNP and fill out the registration form, take action to Donate to BNP, or Contact BNP ; 

(iv) as required by Law; or 

(v) for legal, safety or security purposes. 

By submitting, posting, displaying, providing, uploading or otherwise making available any User Generated Content on or through the Service, you expressly grant, and you represent and warrant that you have all rights necessary to grant, to us a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, reproduce, modify, publish, list information regarding, edit, translate, distribute, syndicate, publicly perform, publicly display, and make derivative works of all such User Generated Content and your name, voice, and/or likeness as contained in your User Generated Content, in whole or in part, and in any form, media or technology, whether now known or hereafter developed, for use in connection with the Website, including without limitation for promoting and redistributing part or all of the Website (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Website a non-exclusive right to access your User Generated Content through the Website, and to use, reproduce, distribute, display and perform such User Generated Content as permitted through the functionality of the Website and under these Terms. You waive all moral rights in your User Generated Content, and you warrant that moral rights have not otherwise been asserted in your User Generated Content. You will not be entitled to any compensation from us if we use your User Generated Content or if your name, likeness, or voice is used or conveyed in connection with the Website.

If you send, transmit, or otherwise provide any feedback, comments, suggestions, questions, or the like, regarding the Website, including any ideas, know-how, concepts, enhancements, recommendations, or other information relating to the Website, including suggesting or recommending changes to the Website such as new features or functionality relating thereto (collectively, “Feedback”), you acknowledge that 

(i) we own, and shall retain ownership of, all right, title, and interest in and to such Feedback, including any Intellectual Property Rights therein, and 

(ii) we may use the Feedback for any purpose whatsoever without any attribution, financial compensation, or reimbursement of any kind to you or any third party.

INTELLECTUAL PROPERTY RIGHTS

DISCLAIMER OF WARRANTIES

TERMINATION

We reserve the right to suspend or terminate your access to the Website with or without notice and to exercise any other remedy available under law, where:

1. you breach these Terms;
2. A third-party reports violation of any of its right as a result of your use of the Website;
3. We have reasonable grounds to suspect any illegal, fraudulent, or abusive activity on your part; or
4. We believe, in our sole discretion that your actions may cause legal liability for others, third-parties or for us, or are contrary to our interests.

INDEMNIFICATION

You agree to defend, indemnify, and hold us and our affiliates and each of our licensors and suppliers (“Indemnified Parties”) harmless, including any employees, members, consultants, and agents of the Indemnified Parties, from any third party allegation, claim, proceeding, liability, damage, or cost (including reasonable attorneys’ fees) arising out of or related to

ENTIRE AGREEMENT

These Terms of Service and any supplemental terms, policies, rules, and guidelines, including the Privacy Policy constitute the entire agreement between you and us and supersede all previous written or oral agreements. If any part of these Terms of Service is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of the parties, and the remaining portions shall remain in full force and effect. The failure to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. We may assign our rights or transfer any or all of our obligations under this Agreement at any time, without prior notice to you.

NOTICE

We may give notice to you by (i) electronic mail to your email address on record, (ii) written communication sent by letter delivered by a nationally recognized overnight delivery service, or (iii) registered post / speed post to your address on record. You are responsible for ensuring that your address on record is current and up to date. You agree that any notice sent to the then-current address in our systems is adequate and binding notice upon you.

CHOICE OF LAW AND DISPUTE RESOLUTION

These Terms shall be deemed to have been entered into and shall be construed and enforced in accordance with the laws of India. The courts in Bengaluru, Karnataka, shall have exclusive jurisdiction with respect to all actions/proceedings arising out of or in connection with this Agreement.

The Website may contain APIs and links to website and websites that we and our affiliates do not own, operate, or control. All such APIs and links are provided solely as a convenience to you. If you use these APIs and links, you will leave the Website. Neither we nor any of our affiliates are responsible for any content, materials, or other information located on or accessible from any third party APIs or website. Neither we nor any of our affiliates endorse, guarantee, or make any representations or warranties regarding any third-party APIs and links, or any content, materials or other information located or accessible from any other websites, or the results that you may obtain from using such APIs and links. If you access any other websites linked to or from the Website, you do so entirely at your own risk.
